General terms and conditions
Minibus VIP Paris by Transly provides transportation services using chauffeur-driven cars (VTC), exclusively by reservation and at a pre-defined price. Transly’s head office is located at 78 av des champs Élysée bureau 326 Paris.
. The company Minibus VIP Paris by Transly is registered with the Registre du Commerce under number 818 568 818 and with the Registre des Exploitants de Voiture de Transport avec Chauffeur of the Ministère de l’Environnement, de l’Energie et de la Mer.
1 – PURPOSE
The purpose of these General Terms and Conditions is to define the conditions applicable to transportation service contracts concluded between Minibus VIP Paris by Transly and its customers. By using the services of Minibus VIP Paris by Transly, the customer is deemed to have read and fully accepted these General Terms and Conditions of Sale.
2 – FORMATION OF THE TRANSPORT SERVICE CONTRACT
The customer can make a service request 24/7 via the www.minibus-vip-paris.com website or by telephone on 06.74.62.69.21. The customer provides all the information concerning the service request. He/she is solely responsible for this information, the following of which is considered essential to the contract: date of transport service, pick-up point, drop-off point, pick-up time, number of passengers (adult/child), number of baggage items, nature of service (transfer, provision). Minibus VIP Paris by Transly sets the price of the service according to the information provided by the customer.
Payment is made by credit card via a secure electronic system. By providing his/her bank details, the customer accepts in advance and unconditionally that Minibus VIP Paris by Transly may proceed with the secure transaction and authorizes its bank in advance to debit his/her account for the amount of the service. After confirmation by the customer of his request for a service and payment of the price, Minibus VIP Paris by Transly will send him, in return, exclusively by e-mail, a reservation form summarizing the information relating to the service. The customer is responsible for checking the information on the booking form. If Minibus VIP Paris by Transly is unable to send the said reservation form by e-mail, the reservation is presumed to comply with the customer’s request.
3 – RATES
Minibus VIP Paris by Transly sets the price of the service according to the information provided by the customer. The prices indicated in our rates include VAT at the rate set by the regulations in force for transport services (10% for transfers, 20% for provisioning), chauffeur service, fuel and unlimited insurance for the persons transported. Parking fees are not included in the service.
4 – REGULATIONS
Payment methods accepted: Cash, Paypal, credit cards (Visa, MasterCard). All transport services by transfer or provision are payable at the time of order.
5 – RESERVATION AND CANCELLATION
5 – 1 – RESERVATION :
All reservations imply unreserved acceptance of these general terms and conditions of sale. The customer and the supplier undertake to respect all the clauses mentioned in the present contract. No modification may be made to the above conditions except by prior agreement between the parties. The present contract shall be suspended or cancelled ipso jure and without compensation of any kind in all cases recognized as force majeure (events outside Minibus VIP Paris by Transly’s control), such as disruption of traffic routes, bad weather, demonstrations, accidents, breakdowns or malfunctions in telecommunications networks, shortages of manpower or materials, etc. The contract shall not be deemed concluded until payment for the order has been received. Failing this, the contract is automatically null and void.
All chauffeur-driven car bookings must be made at least 1 hour in advance via the website or at the last minute by telephone, subject to availability.
Special features for pick-up from train stations and airports:
As soon as you arrive, switch on your cell phone.
Please note the flight or train number in “additional information” when booking.
For flights, if you don’t have checked baggage, the 15-minute wait included in the fare is generally sufficient. However, if you need to retrieve checked baggage and/or if you’re coming from a non-European destination, the time it takes to get off the plane, retrieve your baggage and deal with any law enforcement checks may be quite long.
To avoid having to pay a waiting time, we advise you to add a 30-minute delay.
5 – 2 – CANCELLATION :
A reservation can be cancelled by the customer, before the pick-up time indicated on the reservation form, by e-mail only to contact@minibus-vip-paris.com:
- 90% refund if cancelled more than 24 hours before pick-up time
- 50% refund if cancelled more than 12 hours before pick-up time
- 0% refund if cancellation occurs less than 12 hours before pick-up time.
5 – 3 – PRICE INCREASE / DELAY
Any delay by the passenger(s) in relation to the pick-up time indicated on the booking form will result in an increase in the price of the service, if the customer informs the driver by telephone on 06.74.62.69.21, in accordance with the following terms and conditions:
- More than 15 minutes late: 10 euros
- More than 30 minutes late: 25 euros
- For each additional half-hour’s delay: 25 euros
These surcharges must be paid at the latest when the passenger(s) board the vehicle.
In the event of the customer’s absence from the meeting place after the first 15 minutes free of charge, without any indication from the customer or response to the driver’s telephone call, the service will be definitively forfeited, with no possibility of postponement and no right to claim any reimbursement whatsoever.
6 – SERVICE QUALITY
Passenger transport for hire or reward is a regulated activity. Only authorized vehicles may carry out this service and :
- With a business card number issued by the prefecture.
- With a certificate of registration issued by the French Ministry of Ecology, Sustainable Development and Energy, Bureau de l’organisation du transport routier de voyageurs / pôle VTC.
- With a registration badge affixed to the vehicle’s windshield.
Minibus VIP Paris by Transly undertakes to provide or arrange for the provision of transport services in accordance with the booking form and in compliance with all regulations and legislation in force.
In the event of subcontracting, Minibus VIP Paris by Transly ensures that the persons and companies it uses meet the same conditions.
7 – RESPONSIBILITIES
Minibus VIP Paris by Transly is guaranteed by a solvent insurance company that covers the risks associated with its activity in accordance with current regulations.
In the event of a dispute, Minibus VIP Paris by Transly may only be held liable if the customer can prove that it acted wrongfully and that there is a causal link with the alleged loss.
Minibus VIP Paris by Transly’s Unlimited Multirisk insurance covers business-related liabilities.
The customer is legally and criminally responsible for his actions.
7 – 1 – RESPONSIBILITY OF CUSTOMER AND PASSENGERS
The customer undertakes for himself and for the passengers for whom he has contracted Minibus VIP Paris by Transly to behave like a good father of the family from the moment of pick-up, in particular, by respecting the driver and the transport equipment as well as the following provisions:
- Compliance with the Highway Code (wearing seatbelts, car seats, booster seats, etc.),
- No smoking, eating or transporting hazardous materials. If necessary, your driver will make a stop along the way.
- No alcohol allowed on board,
- Luggage is accepted and remains the responsibility of the customer. Minibus VIP Paris cannot be held responsible for damage to and/or loss of luggage or electronic devices (telephone, tablet, etc.).
- Any damage to the vehicle caused by the customer will be charged in full.
- For all other damage resulting in immobilization of the vehicle:- Invoiced on an actual basis + Immobilization costs + Loss of sales based on an average of the last 3 months.In the event of damage resulting in cancellation of the following service, a fixed charge of €150.00 will be applied in addition, payable immediately by credit card…
- Cleaning in case of vomit will be charged € 150.00 VAT included in addition to the service payable immediately by credit card.
- Small pets are accepted, provided they are in a carrier. Large assistance dogs are allowed.
Failure to comply with these provisions renders the customer and passengers exclusively liable to Minibus VIP Paris and third parties. Minibus VIP Paris by Transly declines all responsibility for the actions of its customers before and after their transport. Minibus VIP Paris by Transly reserves the right to refuse to pick up, or to disembark, a passenger who does not respect these obligations, as well as an alcoholic passenger.
7 – 2 – COMPLAINTS
Any claim is admissible only within 5 days of the transportation service in question, and any dispute shall be referred to the courts of the place where Minibus VIP Paris7 by Transly has its head office.
8 – DISPOSAL / TRANSFER
8 – 1 – TRANSFER :
The transfer service begins at the address of the Minibus VIP Paris by Transly company headquarters and ends when the customer arrives at the agreed address.
8 – 2 – AVAILABILITY :
Transportation is limited to a certain number of kilometers per hour:
- 35 kilometers for 1 hour,
- 150 kilometers for 4 hours.
Any hour started is due in full.
